He wasn't "tattling", users are required to post here airlines that they find in violation of that rule. If you've worked something out with Sami, it's not like he knows about this.

I'm just a little p***ed that a restarted real life airline could reset an airline into which I've poured hours of work.

^ u dun need to start all over again. just tell sami the problem (in this case, airline name) and he should be able to change the airline name for you, free of charge and without doing anything to ur fleet/company image etc., since it isn't ur fault for having the same name.

IMHO there's no need to rebrand the Jet America airline here .. as he didn't know about that startup which was just launched. My opinion is that play this game till it's end and then use another name in next games.

Usually it comes in the form of a Cease & Desist letter and/or email. Then Sami would have a hissy fit.

The fact that ex-SkyBus is able to use the name again shows the name Jet America wasnt trademarked and not owned by Alaska who bought the original Jet America in 1986. What matters is whether or not the name is a trademark

Okay, according to Trademark law as I read it, trademarks prior to November 1989 are valid for 20 years (after 11/89, it's 10 years).  So it's likely that Alaska DID own the trademark, but let it lapse as it made no sense to renew it at the time.

I guess this is a good rule of thumb if you want to use the name of an airline that used to exist in the real world.  If the airline went under more than 20 years ago, then you SHOULD be okay (unless the airline that takes them over keeps the name running, like US Airways with Piedmont, PSA, etc.; that's the gray area).

Sami doesn't seem too worried about it and he shouldn't. It would be hard for a law firm protecting any mark to make the case that the use of the mark on this website is causing dilution and confusion.  Completely different trade channels, obviously this site is not a real airline, etc, etc.

WOW!!! So that means the guy using Eastern Airlines is ok. Ozark would be interesting since in 1999 or so a "new" Ozark was formed flying Dornier 328 Jets

I was wondering.

Here in Denmark and Scandinavia, we had an Airline called Sterling, but i got broke, but got bought by Cimber Air, so now it ended up in a Fusion called Cimber Air - Sterling, does it still violate the rules or what?

Is Freedom Airline trademarked? i googled it and i couldnt find the airline currently. It looked like it existed 5-10 years ago.

Ah, good ol' Freedom Air, a subsidiary of Air NZ...  Flew them a couple times from AKL to CHC.  Good stuff. 

As for right now, Freedom Airlines is a real airline, a subsidiary of Mesa Air, and currently doing business as Delta Connection:
