you know there have been several instances of real world airline names or logos being used and nothings really ever happened to those airlines lol so i mean...meh its let and let live.
It's definitely not being enforced.

I learned after the fact that my most successful airline was probably a rip-off. I ran CeskoSlovensko out of Prague in JA6 and even inadvertently used the same ICAO code CSA. I guess I avoided the lawyers by operating out of a country that doesn't exist anymore. Now they are just Czech Airlines but the code is the same.

That isn't even remotely too close to any existing airline. (and icao code is just a combination of 3 letters that makes no difference in these cases)
